Terms of Service

These terms are the agreement between you and winemap. Please read them. They are written to be understood, and the parts that matter most are at the top.

The short version

1. Who we are and what winemap is

winemap (winemap.vpswb.store) is a website and app where you drop a pin on a map for every wine you drink, with the wine, an optional photo or video, and a rating. You can share pins with friends or the public, comment, like, collect achievements and see leaderboards.

It is run by Bent Verberckmoes, a private individual in Belgium, as a non-commercial project. Contact: support@winemap.vpswb.store. More details are in the Imprint.

2. Who can use winemap

To use winemap you must be old enough to buy and drink alcohol legally in the country where you live.

We set no age limit of our own. The legal drinking age differs per country (for example 16 in Belgium for wine and wine, 18 in the Netherlands, 21 in the United States), and the age that applies to you is the one where you live. If you are below it, please do not use winemap.

When you sign up, start as a guest, or accept updated terms, you confirm that you are old enough. We do not check your age. If we find out that someone is not, we may close the account and delete its data.

5.1 You own it

You keep all rights to your pins, photos, videos, ratings and comments ("your content"). You give us a free, worldwide permission to store, copy, resize, convert and show your content, only as needed to run winemap and only to the audience you choose with the visibility setting. This permission ends when you delete the content, apart from short-lived backups (see the Privacy Policy).

You can send and accept friend requests, comment and like. Friends see your pins according to the visibility you set. You can remove a friend at any time. You are responsible for how you treat other people.

The global leaderboard ranks people by their number of public pins. It shows your username, your badge and your count. You can turn this off at any time in Settings, and you then no longer appear on it.

We follow the EU Digital Services Act. Our single point of contact for authorities and for users is support@winemap.vpswb.store.

The winemap software, name, logo and design belong to the operator and are protected by law. You may use the service as intended. You may not copy, sell or rent it, or build a competing service from its code or data.

11. Liability

We provide winemap with reasonable care, but as a free hobby service we give no guarantee that it is error-free, uninterrupted, or that your data will never be lost.

Nothing in these terms limits liability that cannot be limited by law, including liability for intent, fraud or gross negligence, for death or personal injury, or any of your rights as a consumer that cannot be waived. Subject to that, we are not liable for indirect damage, such as lost profits or lost data, or for the actions of other users or of third-party services.

12. Changes to these terms

We may update these terms, for example when the law or the service changes. If a change is important, we ask you to read and accept the new version in the app before you continue. Smaller changes (such as a typo) are posted here with a new date. If you don't agree with a change, you can stop using winemap and delete your account.

13. Deleting your account

You can delete your account yourself in Settings. We send a code to your email to confirm it, unless your email address is not verified (or you have none), in which case you just confirm in the app. Deleting removes your profile, pins, photos and videos, friend connections, comments and likes. What stays for a short time, and for how long, is described in the Privacy Policy.

14. Law and disputes

These terms are governed by Belgian law. If you are a consumer, you also keep the mandatory consumer protection rules of the country where you live, and you may bring a claim in the courts where you live. If you have a problem, please contact us first at support@winemap.vpswb.store. Most problems can be solved by talking. Consumers can also contact the Belgian Consumer Mediation Service. We are not obliged to take part in out-of-court dispute resolution.

15. If part of this is invalid

If a part of these terms turns out to be invalid or unenforceable, the rest stays in force, and the invalid part is replaced by a valid one that comes as close as possible to its purpose.
