Terms of Service
These terms are the agreement between you and winemap. Please read them. They are written to be understood, and the parts that matter most are at the top.
The short version
- You must be old enough to drink alcohol legally where you live. That age differs per country (see section 2).
- winemap is free and made by one private person. It is a hobby project, not a company.
- You own what you post. You decide who sees each pin. Public pins can be seen by anyone.
- Be decent. Don't post illegal content, don't harass people, and never drink and drive.
- We can suspend accounts that break the rules. We tell you why, and you can appeal.
1. Who we are and what winemap is
winemap (winemap.vpswb.store) is a website and app where you drop a pin on a map for every wine you drink, with the wine, an optional photo or video, and a rating. You can share pins with friends or the public, comment, like, collect achievements and see leaderboards.
It is run by Bent Verberckmoes, a private individual in Belgium, as a non-commercial project. Contact: support@winemap.vpswb.store. More details are in the Imprint.
2. Who can use winemap
To use winemap you must be old enough to buy and drink alcohol legally in the country where you live.
We set no age limit of our own. The legal drinking age differs per country (for example 16 in Belgium for wine and wine, 18 in the Netherlands, 21 in the United States), and the age that applies to you is the one where you live. If you are below it, please do not use winemap.
When you sign up, start as a guest, or accept updated terms, you confirm that you are old enough. We do not check your age. If we find out that someone is not, we may close the account and delete its data.
3. Your account
- Give accurate information and keep your password safe. You are responsible for what happens under your account.
- Tell us at once if someone uses your account without permission.
- You can sign up with an email address or with Google.
- Guest mode: you can log wines without an account. Your guest pins are tied to a cookie in your browser. If you clear it, we cannot link the pins to you again. You can turn a guest into an account at any time and keep every pin. Guests cannot add friends or use some social features.
- You can delete your account at any time in Settings. See section 13.
4. Drink responsibly
- winemap does not encourage drinking more, faster, or at all. Do not use it to compete in drinking dangerously.
- Never drive, cycle or operate machinery after drinking, and don't use winemap while doing so.
- Features such as "drunk mode", streaks and leaderboards are for fun. They are not a breathalyser, not medical advice, and not a measure of whether you are fit to do anything.
- If your drinking worries you or someone close to you, please talk to a doctor or a local support service.
5. What you post
5.1 You own it
You keep all rights to your pins, photos, videos, ratings and comments ("your content"). You give us a free, worldwide permission to store, copy, resize, convert and show your content, only as needed to run winemap and only to the audience you choose with the visibility setting. This permission ends when you delete the content, apart from short-lived backups (see the Privacy Policy).
5.2 You choose who sees it
- Public: visible to everyone, including people without an account, and may be found by search engines. A public pin shows where you were. Think before you publish a pin near your home or workplace.
- Friends: visible only to your accepted friends.
- Private: visible only to you.
5.3 What is not allowed
Do not post or do the following:
- anything illegal, threatening, harassing, hateful, defamatory, or sexually explicit;
- content that promotes dangerous or excessive drinking, or drinking by minors;
- content that infringes someone else's rights, or photos or videos of identifiable people who did not agree to it;
- other people's personal data, impersonation, spam, scams, or advertising;
- malware, or attempts to break, overload or get around the security of the service, other accounts or other users' data;
- bots, scrapers or other automatic tools, or using winemap commercially without our written agreement.
6. Friends, comments and leaderboards
You can send and accept friend requests, comment and like. Friends see your pins according to the visibility you set. You can remove a friend at any time. You are responsible for how you treat other people.
The global leaderboard ranks people by their number of public pins. It shows your username, your badge and your count. You can turn this off at any time in Settings, and you then no longer appear on it.
7. Reporting content and how we moderate
We follow the EU Digital Services Act. Our single point of contact for authorities and for users is support@winemap.vpswb.store.
- To report illegal or rule-breaking content, email us with a link or description of the content, why you think it is a problem, and your name and email address (so we can answer you).
- A person looks at every report. We remove or restrict content that is illegal or breaks these terms, and we tell the person who reported it what we decided.
- We do not use automated tools to decide on removals or suspensions.
8. Suspension and bans
- We may restrict, suspend or ban an account that seriously or repeatedly breaks these terms, harms other people or the service, or is used for something illegal. For smaller problems we warn you first.
- We tell you why. A suspended person sees the reason in the app, and we email it when we have an address. It states what we decided, the reason, and how to appeal.
- Appeal: write to support@winemap.vpswb.store. A person reviews it and answers. If we were wrong, we lift the ban.
- Devices: to make a ban effective, we may also block the browsers and devices that the banned account used, using a random identifier stored in your browser. This is explained in the Privacy Policy. Someone who is banned must not create a new account to get around the ban.
- A banned account's pins are no longer shown to other people.
9. The service itself
- winemap is free. If we ever add paid features or ads, we will tell you first. We will not charge you for what you already use without your agreement.
- We try to keep winemap available, but we cannot promise it will always work. Sometimes we show an "update" screen while we install a new version. Please keep your own copy of anything you cannot lose.
- We may change or remove features. If a change affects what you've paid for or agreed to, we will tell you.
- Maps come from CARTO and OpenStreetMap contributors. Sign-in with Google is Google's service. Their own terms apply to those services.
10. Our rights
The winemap software, name, logo and design belong to the operator and are protected by law. You may use the service as intended. You may not copy, sell or rent it, or build a competing service from its code or data.
11. Liability
We provide winemap with reasonable care, but as a free hobby service we give no guarantee that it is error-free, uninterrupted, or that your data will never be lost.
Nothing in these terms limits liability that cannot be limited by law, including liability for intent, fraud or gross negligence, for death or personal injury, or any of your rights as a consumer that cannot be waived. Subject to that, we are not liable for indirect damage, such as lost profits or lost data, or for the actions of other users or of third-party services.
12. Changes to these terms
We may update these terms, for example when the law or the service changes. If a change is important, we ask you to read and accept the new version in the app before you continue. Smaller changes (such as a typo) are posted here with a new date. If you don't agree with a change, you can stop using winemap and delete your account.
13. Deleting your account
You can delete your account yourself in Settings. We send a code to your email to confirm it, unless your email address is not verified (or you have none), in which case you just confirm in the app. Deleting removes your profile, pins, photos and videos, friend connections, comments and likes. What stays for a short time, and for how long, is described in the Privacy Policy.
14. Law and disputes
These terms are governed by Belgian law. If you are a consumer, you also keep the mandatory consumer protection rules of the country where you live, and you may bring a claim in the courts where you live. If you have a problem, please contact us first at support@winemap.vpswb.store. Most problems can be solved by talking. Consumers can also contact the Belgian Consumer Mediation Service. We are not obliged to take part in out-of-court dispute resolution.
15. If part of this is invalid
If a part of these terms turns out to be invalid or unenforceable, the rest stays in force, and the invalid part is replaced by a valid one that comes as close as possible to its purpose.
